1. Acceptance of Terms

By creating an account or using AI Mold Inspector (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms apply to all users, including inspectors and any authorized representatives.

2. Description of Service

AI Mold Inspector is AI-assisted mold inspection report generation software. It provides a desktop application for collecting field data offline and a web dashboard for generating, editing, and delivering professional mold inspection reports. The Service is intended for use by licensed mold inspection professionals.

3. AI-Assistance Disclosure

Reports generated through AI Mold Inspector are created with the assistance of artificial intelligence. AI-generated content may contain errors, omissions, or inaccuracies. The inspector is solely responsible for reviewing, verifying, and approving all report content before delivery to any client. AI Mold Inspector does not guarantee the accuracy, completeness, or fitness for purpose of any AI-generated content. Delivering an unreviewed report is solely the inspector's responsibility.

4. Inspector Responsibility

You are a licensed professional. AI Mold Inspector is a tool designed to assist your work — not to replace your professional judgment, training, or expertise. You must review every report generated by the Service before delivering it to a client. By approving and delivering a report, you attest that it reflects your independent professional findings and conclusions.

AI Mold Inspector is not responsible for any professional, legal, or regulatory consequences arising from reports you generate, approve, or deliver using the Service.

5. Mold-Specific Disclaimer

Inspection reports generated through AI Mold Inspector do not constitute a warranty or guarantee of mold-free conditions at the inspected property. Mold conditions can change after an inspection due to environmental factors, moisture intrusion, or other causes beyond the inspector's control.

Reports are prepared for the named client only and are not transferable. Subsequent property owners, buyers, or third parties may not rely on these reports without the inspector's express written consent.

6. Subscription Terms

AI Mold Inspector offers paid subscription plans billed monthly. Your subscription begins on the date you provide payment information and auto-renews monthly unless you cancel.

• Free trial: New accounts receive a 14-day free trial with full access to all features. No credit card is required to start a trial.
• Auto-renewal: After the trial period, your subscription will auto-renew monthly at the plan rate you selected. You will receive a reminder email before the first charge.
• Cancellation: You may cancel at any time from the Billing section of your dashboard. Cancellation takes effect at the end of the current billing period. We do not provide prorated refunds for partial months.
• Price changes: We will provide at least 30 days' notice before changing subscription prices.

7. Prohibited Uses

You may not:

• Resell, sublicense, or redistribute access to the Service to third parties
• Reverse engineer, decompile, or attempt to extract the source code of the Service
• Use the Service to generate fraudulent, misleading, or inaccurate inspection reports
• Use the Service in any way that violates applicable law or professional regulations
• Attempt to circumvent usage limits, rate limits, or authentication mechanisms
• Upload malicious files, scripts, or code to the Service

8. Data Handling

We store your inspection data, photos, and account information on secure servers. You own your data. We will not sell, license, or share your inspection data with third parties except as necessary to operate the Service (see our Privacy Policy).

You are responsible for ensuring that any client data you enter into AI Mold Inspector is handled in compliance with applicable privacy laws in your jurisdiction.

9. Limitation of Liability

To the fullest extent permitted by law, AI Mold Inspector's total liability to you for any claim arising out of or relating to the Service is limited to the subscription fees you paid in the three months preceding the claim.

AI Mold Inspector is not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, or damages arising from decisions made based on report content — even if we were advised of the possibility of such damages.

Some jurisdictions do not allow these limitations; in those cases, our liability is limited to the extent permitted by law.

10. Termination

You may terminate your account at any time by canceling your subscription and using the "Delete Account" option in Settings. We may suspend or terminate your account immediately if you violate these Terms or if required by law.

Upon termination, your access to the Service will end. You may request a data export before closing your account by contacting [email protected].

11. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes must be resolved in the state or federal courts located in California.
